1. Acceptance of Terms
By accessing or using the Aquatic Park Sailing Club (“APSC”) website and member portal (collectively, the “Service”), you agree to be bound by these Terms of Service. If you do not agree, please do not use the Service.
2. Who May Use the Service
The public areas of the website are available to anyone. The member portal is available only to current APSC members in good standing. You are responsible for keeping your sign-in credentials confidential and for all activity under your account.
3. Member Conduct
When using the Service, you agree not to:
- Post content that is unlawful, harassing, defamatory, or infringing.
- Impersonate another person or misrepresent your affiliation with the club.
- Share member contact information or directory data with anyone outside the club.
- Attempt to gain unauthorized access to the Service, other accounts, or any connected system.
- Use the Service to send unsolicited commercial messages.
4. Member-Submitted Content
You retain ownership of content you submit (photos, posts, comments, etc.). By submitting content, you grant APSC a non-exclusive, royalty-free license to display and distribute that content within the Service for the purpose of operating the club. You are responsible for the content you submit and for ensuring you have the right to share it.
5. Club Membership
These Terms govern use of the Service only. Club membership, fees, work-hour requirements, mooring assignments, and other club operations are governed by the APSC bylaws and board policies, which are provided separately to members.
6. Privacy
Your use of the Service is also governed by our Privacy Policy.
7. Disclaimers
The Service is provided “as is” and “as available”, without warranties of any kind, express or implied. APSC does not warrant that the Service will be uninterrupted, error-free, or secure. Information on the site (including weather, racing schedules, and club events) may change without notice.
8. Limitation of Liability
To the maximum extent permitted by law, APSC, its directors, officers, and volunteers shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service.
9. Termination
We may suspend or terminate access to the Service for any user who violates these Terms or whose club membership ends. Members may close their accounts by contacting the club.
10. Governing Law
These Terms are governed by the laws of the Province of Ontario and the applicable laws of Canada.
11. Changes to These Terms
We may update these Terms from time to time. Material changes will be communicated to members via the member portal or email. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
